The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. This paper describes the unique values of, challenges within, and opportunities presented by embedded ELSI ethnography. Drawing from our six‐year embedded ELSI study of the WISDOM (Women Informed to Screen Depending on Measures of Risk) trial, we present three examples of the variable ways we engaged with the WISDOM trial's scientific team. WISDOM is a preference‐sensitive, pragmatic, randomized controlled trial of risk‐based breast cancer screening informed by genomics. Our embedded ELSI approach included multiple modes of engagement: (a) Trial investigators sought (...) bioethics expertise; for example, we were asked to consult on traditional bioethics topics such as consent as well as more complex questions about whether to implement a specific risk‐assessment approach on only one race‐defined group of trial participants. (b) As the ELSI investigators, we identified ethical concerns in issues that surfaced via ethnography and considered them in the Bioethics Working Group; for example, there were concerns about the implementation processes that the WISDOM team viewed as logistical challenges. (c) Our presence in WISDOM working group conversations and our expertise on classic social science topics, including race and gender, offered opportunities to engage on the spot with topics such as how to include transgender participants in a trial initially focused on “women's health”; through such engagement, the value of social science became clear to the trial investigators. The paper elaborates on the dynamic relationship between our ethnographic observations, the Bioethics Working Group discussions, and the contributions of each to our real‐time ELSI interventions in these examples. The methods and experiences we describe here suggest modes of engagement that, in combination, have the potential to expand the role of ELSI to offer real‐time intervention on issues related to equity, inclusion, and justice in genetic and genomic research. Cloth, $79.This important book contributes much to the growing, though divided, scholarship on Greek mortuary practice as a system of behavior that reflected and constructed eschatological, religious, and socio-political attitudes (...) and ideologies. Distancing herself strongly from I. Morris’ historical analysis of mortuary data (Burial in Ancient Society [1987]; Death-Ritual and Social Structure in Classical Antiquity [1992]), with its rejection of what he sees as limiting text- and object-based approaches, S-I derives cultural attitudes from texts like Homer and artifacts like the archaic grave monument. Her approach to this conventional material is hardly conventional, however, nor are its results.Chapter 1, which most classicists could read with benefit, explains S-I’s reader-oriented method; but methodology is foregrounded throughout, especially the semiological principle that no element of a text or artifact, independent of its context, has a fixed meaning for readers. S-I recreates ancient readings of grave monuments, epitaphs, literary texts, and other artifacts accordingly, by reconstructing the cultural lenses through which contemporaries would have interpreted such an artifact (that is, their attitudes to death, expectations about relevant genres, and other aspects of their cultural repertoire). To alleviate the dangers of circularity inherent in such approaches, S-I constructs, and criticizes others for failing to construct, several independent arguments to support each point. Though “very idiosyncratic post-structuralist” (113), S-I’s method can be compared to recent semiological, cultural, and functional approaches to literary and artistic “texts” (e.g., C. Dougherty and L. Kurke, Cultural Poetics in Archaic Greece [1993]) and inscriptions (e.g., D. T. Steiner, The Tyrant’s Writ [1994]).Chapter 2 deals with views of the afterlife in the Homeric poems and with beliefs about the dead from the Late Bronze Age to the seventh century. For S-I, Homer represents the culture of eighth-century Ionia, and she uses the poems to show later eighth-century attitudes toward death. This is too facile a solution to complex Homeric problems, and while her analysis of the beliefs reflected in the poems is excellent, she does not apply archaeological evidence to demonstrate that this analysis is relevant to eighth-century Greece. She sees two attitudes in the poems: the predominant belief that “everyone must die,” a simple statement of the inevitability of death without any idea of reward and punishment, and the nascent idea that a few individuals can achieve happiness and even immortality after death. She debunks the theory that this latter concept of Elysion comes from Minoan Crete. What she does not do is use archaeological evidence to support her hypotheses. As she rightly points out, reconstructing “belief systems on the basis of archaeological data is a complex and problematic enterprise” (90); [End Page 645] but given the hundreds of burials excavated all over the Greek world from this period, it seems amazing that she refers to them so little. S-I is not unfamiliar with archaeological evidence and uses it to good account in discussing Minoan and Mycenaean burial practices, and she makes excellent use of sculpture and vase painting in chapters 3 and 5; but she chooses not to use actual burial data for Homeric beliefs, perhaps partly in response to Morris. Chapter 2 supplies a useful background for the study of archaic grave markers, but the unwary classicist should know that a methodologically rigorous archaeologist, in particular, will have trouble with it, as with Morris, although for different reasons.Morris and his methodology come under heavy attack in the lengthy Appendix. While some find Morris’ model-building methodology problematic, it is widely accepted by anthropologists looking for an objective method akin to scientific hypothesis testing. This paper explores the idea that wellbeing and healthy development should be the central goal of school music programs. After establishing a framework of student wellbeing, the metaphor of rites of passage experiences is employed—through Joseph Campbell's hero's journey and Jane McGonigal's analysis of the benefits of online gaming—as one way to think about high school music programs as potential sites for contributing to optimal adolescent wellbeing. Writing at the nexus of practice and theory the authors analyze two rites (...) of passage examples from their high school music classrooms. Musicking experiences that offer students openings for embarking upon rites of passage hold potential for addressing students' needs for autonomy, relatedness, and competence—needs Richard Ryan and Edward Deci document as predictive of psychological wellbeing in all cultures and that Dissanayake argues are evolved psychobiological needs. Kasper's Theology and Church (pp. 94-108; Kasper says simply, "Rahner's characterization of neo-Chalcedonianism is historicaly inaccurate," p. 214, note 18). As it is, Ols's treatment reminds us that Rahner's own writings, which overlooked the later Councils of Constantinople, presume that Chalcedon had been the end of a development in Christology; this inaccurate presumption (...) has dominated too much of the writing which has followed Rahner's essay. Ols returns to this problem of " latent monophysitism " in some classical christologies in the final chapters of his work (VIII-XI). With a careful examination of the christology of Aquinas, the author skillfully demonstrates the rich development of Christ's true humanity that is possible within the classical approach; he deals specifically with the topics of Christ's knowledge, his sinlessness, and the concept of person. (It is interesting to note that, like Rahner and others before and after, Ols thinks that the word "person" is not particularly felicitous and would prefer simply the word hypostasis or subsistence [p. 187]. His wish is likely to have no more success than previous suggestions in this regard.) Although limited in its intent, this hook is rich in many ways. Ols's knowledge of St. Thomas is deep, and he uses that knowledge well. His critique of Rahner and Schilleheeckx may he forceful in its negative assertions, hut I believe it is accurate in pointing out the philosophical idealism that underlies much of their christological writings. This idealism is too often overlooked and needs the corrective of what we might call "Mediterranean realism." Although his criticism may he incisive, it is never unfair or strident, and he is aware of the positive insights that these men have contributed to our continuing reflections on the Lord. By intent, Ols's work is essentially one of evaluation and criticism. Nevertheless, the chapters that reflect on (and develop) Aquinas's teaching and give a positive presentation of the real human· ity of the Lord lead one to hope that the author will follow this study with a fully elaborated christology. Several good hooks on Kant's political philosophy have appeared in the past decade, hut the literature on Kant's political philosophy is still both slimmer and weaker than on any other aspect of his thought. 536 BOOK REVIEWS Though we still await a definitive study of the topic, this book goes a long way toward filling some important gaps. Even the best books on Kant's political philosophy tend to treat only the broad outlines of Kant's position, shying away from detailed exposition of Kant's theories of individual right and external possession and of the political theory based on them. Mulholland's is not only the most detailed but also the most persuasive account of these matters which has yet been presented in English. The book's first four chapters attempt to lay the foundations for Kant's political philosophy through a general discussion of his ethical theory. The main function of these (somewhat overlong) introductory chapters is to argue for a tension between the law of nature formula (which Mulholland prefers as a guide to Kant's theory of right) and the formula of humanity as end in itself. According to Mulholland, the law of nature formula leads to a theory of rights and political obliga· tion which places Kant in the natural law tradition, whereas the formula of humanity commits him to what Mulholland calls the " deed principle ": that acquired rights can come about only through a deed on the part of those having the duties corresponding to the rights through which these duties have been assumed. Mulholland argues that if we take the deed principle strictly, then we must base political obligation on consent and thus on a social contract. The burden of Mulholland's argument throughout the book is that Kant cannot sustain the deed principle, and it is... (shrink)

Kockelmans provides a clear and systematic treatment of the central themes and topics of Heidegger's later writings, focusing on the all-important question of the relationship of truth and Being. If we are to understand Heidegger's thought, Kockelmans explains, we must conceive it as a path or way, rather than as a finished system. Adopting this approach himself, Kockelmans leads us with scholarly care through the wide range of issues that Heidegger wrote about between roughly 1935 and 1965. (...) Or l'elaboration parallele de l'expose de l'empirisme philosophique (Darstellung) et, plus (...) tardive, de la Philosophie rationnelle a retenti dans l'intervalle sur la signification du Monotheisme. La distinction de plus en plus accusee d'un negatif rationnel et d'un positif historique englobe desormais celle de la Mythologie ou du paganisme et de la Revelation ou du christianisme. Toward a Metaphysics of Culture provides an initial, minimal, and original analysis of the concept of uniquely enlanguaged cultures of the human world and of the distinctive metaphysical features of whatever belongs to the things of that world: preeminently, persons, language, actions, artworks, products, history, practices, institutions, and norms. Emphasis is placed on the artifactual and hybrid nature of persons, naturalistic and post-Darwinian evolutionary considerations, and the bearing of the account on a range of disputed inquiries largely centered on the (...) relationship between physical nature and human culture and between the natural and human sciences. The schema offered lays a foundation for a closer analysis of the human mind, cognition, interpretation, nomologicality, normativity, intentionality, realism, and related matters. The central thesis advances the heterodox notion, congruent with post-Darwinian studies in paleoanthropology, that the human person is a natural artifact, a functional transform of the primate members of Homo sapiens, by way of a complexly intertwined biological and encultured evolution, primarily dependent on the invention, transmission, and mastery of true language and the novel hybrid abilities that that makes possible. Lam, Joseph Peter Fitzsimons is a competent journalist who does not shy away from expressing his personal opinion on controversial social and ethical issues. In a Sydney Morning Herald online comment published on 11 December 2016, he not only praised the courage of the premier of Victoria, Daniel Andrews, but also appealed to members of the New South Wales parliament to follow Andrews' lead to legalise euthanasia. Anticipating the eventual collapse of his own health in the future, Fitzsimons insisted (...) that lawmakers should respect his autonomy and his choice of a peaceful and dignified death. As far as I can see, however, respect for a person's autonomy is not the main problem here. Rather, the key difficulty rests with Fitzsimons's reasoning. He argued: Let's say that at the age of 80 or so, I decide that my meaningful life is over, and all that awaits me is-I know, I know, too much detail- incontinent pain for the next five years. And let's say that I don't want that, and would rather pass away peacefully, and with dignity, in a medically supervised manner. My question to the opponents of euthanasia: if I choose to do that, what business is it of yours? (shrink)

The English polymath Joseph Priestley wrote on a wide range of scientific, theological and pedagogical subjects. After the appearance of his influential Rudiments of English Grammar and A Course of Lectures on the Theory of Language and Universal Grammar, both of which are reissued in this series, Priestley produced in 1765 his Essay on a Course of Liberal Education, which is included and expanded on in this 1778 publication. Here he explains the reasons behind his decision to guide the (...) curriculum at Warrington Academy towards a greater focus on subjects with a more direct application to 'civil and active life'. He offers more general instruction on the cultivation of young men in various spheres, notably through foreign travel and developing 'knowledge of the world'. Parkinson, Joseph Bioethics at the bedside looks different from bioethics in the classroom, because the patient in the bed is a person with their own particular history, a unique experience of illness, and an unrepeatable future. In the context of Christian faith, bioethics must include far more than mere clinical data and academic prowess: there must be a central role for the God who is mystery. This article reflects on the rich perspective of leading American paediatrician and ethicist, Bioethics (...) has never been an exact science. Even when it strives for absolute objectivity by the application of the most rigorous philosophical discipline, clinical situations often escape our capacity to arrive at certain judgement. This should not surprise us, of course, since clinical situations are often extremely complex human dramas, and in such matters, as Aristotle reminds us, we should never expect greater certainty than our subject matter allows. Arthur Fine has recently argued that standard realist and anti-realist interpretations of science should be replaced by "natural ontological attitude" (NOA). I ask whether Fine's own justification for NOA can meet the standards of argument that underlie his criticisms of realism and anti-realism. Fine vacillates between two different ways of advocating NOA. The more minimalist defense ("why not try NOA?") begs the question against both realists and antirealists. A stronger program, based on Fine's arguments for a "no-theory" of truth, has (...) promise, but the arguments must be developed in a stronger, more general form if they are to justify NOA. (shrink)

Technological advancements, especially with regard to enhancements of human capacities and powers, have instigated a collision between opposing views of the human person. I begin with the premise that the predominant classical view of the human person attained its clearest and most cogent expression in the philosophy of Thomas Aquinas and can be termed the theory of the homo integralis. The human person is, for Thomas, the integrated being par excellence: he is a union of the material (body) and the (...) immaterial (soul); his freedom is guided by a normative nature; he is himself a product of and participant in nature; he is a member of a common species from which he draws his identity; and he balances the needs of his embodied state with a recognition that his existence is not limited to it. Due to the philosophical and technological revolutions of the modern period, themselves an outgrowth perhaps of earlier attitudes, a contrasting view of the human person emerged: the homo technologicus. Technological man, unlike his classical predecessor, is marked by fundamental disintegration: he is divided in himself, between mind and body; he is dissociated from a normative human nature; he is divided from nature itself as he sets himself against it through technological means; he is divided from the human community in radical, self-determining autonomy; and he is severed from any sense of transcendent purpose or value aside from that which can be attained through his own powers, technological or otherwise. By recovering a sense of the homo integralis as articulated by Thomas Aquinas, a fresh appraisal of contemporary issues regarding the human relationship to technology, human capacities and powers as evaluated by movements like transhumanism, and ultimately, human meaning and value, is made possible and is shown to provide a consistent and appealing rejoinder to the disintegrated vision of man that emerges in a technologized world.
